Virginia Marriage License Requirements

 
In Virginia, marriage licenses are issued by the Circuit Court Clerk’s Office in each county or city. You can apply for a marriage license at any Circuit Court Clerk’s Office in the state, regardless of where you plan to hold your wedding.
Marriage License Fee: The fee varies by county but is generally around $30.
Waiting Period: None; the license is effective immediately upon issuance.
Validity: 60 days; you must marry within 60 days of the license being issued.
Witnesses: Not required.
Age Requirements: Both parties must be 18 years or older to marry without parental consent.
 
Application Preparation
Both parties must appear together in person at the Circuit Court Clerk’s Office to apply.
Each applicant should provide a valid photo ID, such as a driver’s license, passport, or military ID.
Social Security numbers are required; however, your Social Security card is not necessary if you know the number.
If previously married, you should know the exact date of your divorce or the date of your former spouse’s death.
Additional Information
There are no residency requirements in Virginia; non-residents can marry in the state.
Cousin marriages are permitted.
 
Marriage License Package
After obtaining your marriage license, you may choose to have a civil ceremony performed at the courthouse or by a qualified officiant elsewhere. If you plan to marry outside the court, ensure you have the marriage license ready for your officiant.
 
Certified Copy of the Marriage Certificate
After your marriage ceremony, the officiant will return the completed marriage license to the Circuit Court Clerk’s Office for recording.
To change your last name with the Department of Motor Vehicles, Social Security Administration, employer, passport agency, or for immigration/embassy services, you will need a certified copy of your marriage certificate.
Certified copies can be obtained from the Circuit Court Clerk’s Office where the license was issued, typically for a fee of $2.50 to $3.00 per copy.
 
Expedited Services
Some Circuit Court Clerk’s Offices may offer expedited processing for obtaining certified copies. It’s advisable to contact the Clerk’s Office where your marriage license was issued to inquire about self-returns.
